   Toronto Township, York County, Ontario, Canada

   Barbara Harvey, a widow from York Township, bequeathed her entire real and personal estate to her son-in-law, John Allen, in an 1878 will witnessed by Thomas Lister and George Buggs. While Allen was named the sole executor and beneficiary, the inheritance was subject to a lifelong restriction preventing him from selling or mortgaging the property during his lifetime.

   In H. M. Sur. Ct. of the Co. of York — Be it Known that on the 31st day of May A.D. 1878 the last Will & Test of Barbara Harvey late of the Tp. of York in the Co. of York, Widow, who died on or about the 11th day of May A.D. 1878 at the said Tp. York and who at the time of her death had a fixed place of abode at the said Tp. York in the said Co. of York was proved & registered in the said Sur. Ct. a true copy of which last Will & Test is hereunder written. Administration of all and singular the personal estate and effects of the said deceased was granted by the court to John Allen of the Tp. Vaughan in the Co. of York, Innkeeper, the Executor named in the said Will.

   Last Will and Testament of Barbara Harvey
   This is the last Will & Test: of me Barbara Harvey made this 2nd day of April A.D. 1878 as follows:

   I Barbara Harvey give devise & bequeath all my messuages lands & tenements & hereditaments & all my household furniture, ready money, Securities for money, money secured by Life assurance, goods & chattels, & all other my real & personal estate & effects whatsoever & wheresoever unto John Allen my Son in law his heirs, Exors, admors & assigns to and for his & their own absolute use & benefit according to the nature & quality thereof respectively subject to the following proviso, viz — that he the said John Allen shall not either sell or mortgage said property during the term of his natural life.

   Subject also to the payment of my just debts funeral expenses, testamentary & otherwise & the charges of proving & registering this my will and I appoint said John Allen my sole Exor of this my will, & I hereby revoke all other wills.

   In witness whereof I have hereunto set my hand & seal the day & year above written.
